Jury Duty and Court Appearance - Template Policy

ELIGIBILITY



  • Regular full time employees on active status are eligible for jury pay/subpoena after completion of the 90-day probationary period.
  • Part time employees (less than 30 hours per week) are not eligible.
  • Temporary employees are not eligible.

COMPUTATION OF PAYMENT FOR ABSENCE

  • The maximum jury duty/court-ordered appearance pay would be up to five (5) days or up to a maximum of 40 hours pay.
  • Pay for the absence is computed at the regular hourly rate to a maximum of eight (8) hours for one day for regular full time employees and six (6) hours for regular part time employees.
  • Time off granted in accordance with this policy shall not be credited as time worked for the purpose of computing overtime.
  • The employee may keep compensation received for serving on jury duty.
  • Because the company is paying for time at court, it is expected that the employee report back to work when off for the day or if excused early.

EVIDENCE OF REASON FOR ABSENCE

The company requires verification of the absence prior to payment.

PROCEDURE

Employee
  • Notify supervisor of jury summons/subpoena.
  • Provide confirmation from the court verifying dates and times of service.
(NOTE: The jury summons is not sufficient)
